Artificial intelligence has rapidly moved from experimentation to expectation. In the FATCA and CRS due diligence world, where complexity, scale, and regulatory scrutiny intersect, AI feels like the long-awaited solution. It can read documents, flag anomalies, automate classifications, and complete in seconds what once took teams days. 

It’s no surprise, then, that organisations are moving quickly to adopt it. 

However, while most firms are focused on what AI can do, far fewer are considering what it could expose. And that’s where the real risk begins. 

 

Data Handling: Where Control Is Assumed, Not Proven 

AI doesn’t simply process data in a linear, predictable way. It ingests, interprets, and interacts with information across systems, often in ways that are not fully visible to the organisation using it. 

The challenge is not the capability itself, but the lack of clarity around how that data is handled. Where is it being stored? Who has access to it? Could it be reused, retained, or even incorporated into broader models? 

In a FATCA and CRS context, these are not theoretical concerns. The data involved is highly sensitive, both financially and personally. If that data leaves a controlled environment, even unintentionally, the implications can be immediate and significant.

Over time, this creates an environment where sensitive client information may be processed through external tools, without oversight, governance, or auditability. The risk here is not just the exposure itself, but the fact that it happens invisibly. 

And risk you cannot see is risk you cannot manage.

 

Output Risk: Where Confidence Replaces Accuracy 

AI is designed to be helpful, and it is often highly convincing in how it presents information. That is precisely what makes it dangerous in a regulated environment. 

It can produce outputs that appear correct, sound authoritative, and are delivered with confidence, even when they are inaccurate. 

In FATCA and CRS due diligence, this is not a minor issue. Incorrect classifications, misinterpreted data, or flawed assumptions can flow directly into reporting and compliance processes. Once that happens, the consequences extend beyond operational inefficiency into regulatory exposure. 

There is no margin for “almost right.” 

 

Explainability: Where AI Collides with Regulation 

Regulatory environments require decisions to be explained, not just executed. 

It is not sufficient to arrive at the correct outcome; organisations must be able to demonstrate how that outcome was reached. This becomes challenging when using AI models that operate as black boxes. 

If you cannot clearly explain why an entity was classified in a certain way, or how a validation decision was made, you create a gap between operational efficiency and regulatory defensibility. 

In FATCA and CRS, that gap matters. 

 

Third-Party AI: Where Risk Extends Beyond Your Walls 

Many AI capabilities rely on third-party providers, which introduces an additional layer of risk. 

By using external tools, organisations extend their data environment beyond their own infrastructure. This means inheriting the security posture, data handling practices, and potential vulnerabilities of those providers. 

Even if internal controls are strong, weaknesses in the broader supply chain can introduce exposure. In highly regulated environments, that risk cannot be ignored. 

 

Why This Breaks Faster in FATCA & CRS 

FATCA and CRS due diligence is particularly sensitive to these challenges because of its nature. It is data-intensive, highly regulated, cross-border, and subject to ongoing audit scrutiny. 

Errors introduced early in the process do not remain isolated. They propagate through onboarding, validation, and reporting, becoming harder to detect and more complex to correct over time. 

Once data is accepted as a source of truth, it becomes embedded in downstream processes. At that point, the cost and risk of remediation increase significantly. 

 

The Illusion of Control 

One of the more subtle risks with AI is the illusion that it is under control simply because it appears to be working well. 

When a system delivers results quickly and efficiently, it creates a sense of confidence. However, functionality and security are not the same thing. 

A system can be highly effective and widely adopted while still introducing significant, unseen risks. Assuming that performance equates to safety is one of the most dangerous conclusions an organisation can make. 

 

What a More Mature Approach Looks Like 

The organisations that are approaching AI effectively are not slowing down adoption. Instead, they are embedding governance and control into how AI is used. 

This starts with visibility. Understanding who is using AI, which tools are being used, and what data is being processed is fundamental. Without this, meaningful control is impossible. 

It also involves creating controlled environments where AI can be used safely. This includes implementing data masking or anonymisation, enforcing access controls, and integrating AI usage into existing compliance frameworks. 

Beyond this, there is a clear distinction between experimentation and production. Production-ready AI must be rigorously tested, continuously monitored, and governed by clear policies. It should meet the same standards as any other critical system within the organisation. 

Finally, policies and training play a crucial role. Teams need clear guidance on which tools are approved, what data can be used, and how AI should be applied responsibly. Without this, risk will scale faster than adoption. 

 

The Real Competitive Advantage 

Security is often seen as a constraint on innovation, but in FATCA and CRS, it is a differentiator. 

Organisations that can demonstrate strong AI governance, robust data protection, and clear auditability will be better positioned with regulators, clients, and partners. Trust remains the foundation of this industry, and how AI is managed will increasingly shape that trust. 

AI has the potential to transform FATCA and CRS due diligence, reducing manual effort, improving accuracy, and unlocking meaningful efficiencies. But the question is not whether AI will be used. It is whether it will be used in a way that is secure, visible, and defensible. Because in this space, the greatest risk is not that AI fails. It is that it succeeds without the controls required to contain it.
